La reforma híbrida. Las transformaciones constitucionales a las instituciones de justicia y al Estado mexicano en la última década

    En este artículo se analiza la profundidad de la reforma judicial en curso en México y las consecuencias para la construcción de un Estado democrático de derecho. El autor analiza tres grandes reformas complejas, la reforma de la justicia de menores, la reforma penal que crea el sistema acusatorio oral, y la reciente reforma de derechos humanos que transforma profundamente tanto la Constitución como el sistema normativo general en el país. Las reformas no tienen una dirección única y varios aspectos de las mismas han producido efectos ya negativos en el ejercicio de derechos y el acceso a la justicia para la población. El autor propone una teoría del cambio institucional y 13T un conjunto de hipótesis relacionadas con la hibridez e isomorfismo organizativo para interpretar la transformación tanto del sistema judicial y el Estado de México, y analiza un conjunto específico de cambios legales en los estados mexicanos.

    This article analyses the depth of the ongoing judicial reform in Mexico and the consequences for the construction of a Democratic Rule of Law. The author analyzes three major complex reforms, the juvenile justice reform, the penal reform that creates the accusatory-oral system, and the recent Human Rights Reform that deeply transforms both the constitution and the overall normative system in the country. Reforms have no a unique direction and several aspects of them have produced already adverse effects in the exercise of rights and access to justice for the population. The author proposes a theory of institutional change and a set of hypothesis related to hybridism and organizational isomorphism to interpret the transformation of both the judicial system and the Mexican State, and analyzes a specific set of legal changes in Mexican states.
