Problemática de la mediación penal en Veracruz

    El Código de Procedimiento Penal de Veracruz, contempla un trámite de mediación que puede efectuarse durante el período de investigación ministerial, cuando se refiera a delitos perseguibles por querella. El objetivo de esta mediación es poder llegar a un convenio entre las partes, con la finalidad de concluir dicha investigación. Sin embargo, en la mediación se advierten algunos problemas que afectan la seguridad jurídica de quienes realizan dicho acuerdo; algunos de ellos se refieren a la naturaleza jurídica, validez y efectos de este convenio. La reflexión sobre estos aspectos es el objetivo de este trabajo.

    Veracruz’s Criminal Procedure Law provides a mediation process that may take place during the police investigation, if it is related to crimes that are prosecuted by complaint. The aim of this mediation is to reach an agreement between the parties, in order to conclude the investigation. However, as regard mediation, there are some issues concerning legal certainty of those making the agreement. Some of these issues are related to the legal nature, validity and effects of this agreement. The aim of this paper is to reflect on them.
