    ¿Cómo ilegitima Nietzsche los fundamentos que construyen y sustentan la responsabilidad personal como justificación de la pena? ¿Cuáles son esos fundamentos y de qué manera pueden ser legitimados? Estas son las preguntas que se abordarán en el presente trabajo; para ello, se hará una exposición de la noción de responsabilidad, con base en el libro Responsabilidad jurídica y libertad, de cara a sustentar los fundamentos de la responsabilidad personal. Posteriormente, se presentará una interpretación de lo dicho por Nietzsche en La genealogía de la moral, partiendo de una lectura del texto como una exégesis de la frase “más allá del bien y del mal”, a partir de la cual se aproximará a esclarecer la crítica del autor, a la posibilidad de fundar una responsabilidad Personal como justificación de la pena.

    How illegitimate Nietzsche the foundations that construct and sustain the Personal responsibility like justification of the pain? Which are those foundations and how can be legitimized? These are the questions that will be approached in the present work;

    for it, a exhibition will become of the responsibility notion, with base in the book Legal responsibility and freedom, facing sustaining the foundations of the Personal responsibility. Later, an interpretation of the saying by Nietzsche will appear in The Genealogy of the moral, starting off of a reading of the text like a exegesis of the phrase “beyond the good and of badly”, from which one will come near to clarify the critic of the author, for the possibility of founding a Personal responsibility like justification of the pain.
