El surgimiento de los llamados derechos colectivos y difusos en el panorama del Derecho procesal, tanto en la doctrina como en las diversas legislaciones nacionales responde a un hecho más profundo que a una simple variación terminológica: se trata de una manera diferente de concebir las relaciones entre los poderes del Estado y los derechos de los ciudadanos respecto a uno de los poderes estatales, el judicial. En el ámbito político, debe decirse que, la justicialidad de esos derechos de incidencia colectiva no puede reducirse a algo meramente administrativo, como hoy ocurre en México. Es necesario modificar el conjunto de la organización judicial, de manera que su intervención en la tutela de estos intereses sea efectivamente garantista. Esto no puede seguir siendo atribución exclusiva de algunos órganos administrativos del poder ejecutivo. La adecuación de esta organización de lo judicial no es un problema meramente técnico, sino que debe resolverse desde la toma de decisiones políticas. A través de este artículo se ilustra el camino allanado por el procesalismo español, dando cauce a este tipo de derechos que superan el mero interés individual, para dar cabida a los litigios de naturaleza suprapersonal.
The rising of the so called collective and diffuse rights within the scope of Procedural Law, in doctrine as well as in different national legislations, answers more to a deeper fact than to a simple terminological variation. It is different way to conceive the relationship between the power of the State and rights of the citizens concerning one of the State powers, the judicial one. In the political field, it must be said that the justiciality of those rights of collective incidence cannot be reduced to something merely administrative, as it occurs in Mexico. It is necessary to modify the judicial organization, in such a way that its intervention upon the tutorship of the these interests actually is guarantist. This cannot continue being an exclusive attribute of some administrative organs of the executive power. The adequacy of this judicial organization is not only a technical problem, but it has to be solved from the very making of political decisions. The road, paved by the Spanish proceduralism, is shown in this article, leading to this kind of rights which go beyond a mere individual interest and give way to trials in a more suprapersonal nature.
