    • The confused action by the European Commission i n c h a n g i n g t h e regulatory archetype of transnational investment protection The position of the EU after the Lisbon Treaty has been a rejection of the still existing settlement of investment disputes provided in the BITS and the Treaty on the Energy Charter, regardless of their income and contributions. This position has been conditioned by two circumstances:

      first, receiving some radical opposition movement from certain groups, which has the virtue of politicizing the matter when precisely the investment arbitration was born with the aim of depoliticizing this type of litigation; second, the EU negotiations with the US aimed at achieving a transatlantic agreement on trade and investment. In the latter case, having to set rigid positions on the approaches to the counterparty, t h e Commission has been forced to adopt some criteria on transparency, possible creation of an appellate court, enforcement of arbitral awards and future possible appeal mechanisms, but for this operation has not had a well structured documentation departure.
