Nuevas reformas de la ley concursal

    En línea con las últimas reformas de la Ley Concursal, encaminadas a lograr la continuidad de empresas viables desde un punto de vista operativo, pero que no lo son desde una perspectiva financiera, la Ley 9/2015 vino a convalidar el texto del RDL 11/2015 y, adicionalmente, aclaró algunas dudas surgidas, introdujo mejoras técnicas y modificó algunos preceptos para incrementar la efectividad en la incentivación de la firma acuerdos de refinanciación y de la extensión de sus efectos a acreedores disidentes y, asimismo, para favorecer la venta unidades productivas rentables. A su vez, para el caso de que fracasen tales medidas, mediante el RDL 1/2015 (tramitándose como Proyecto de Ley), se introduce, con mayor o menor acierto respecto de sus condicionamientos, el mecanismo de segunda oportunidad, como excepción al principio general de responsabilidad patrimonial universal del deudor

    In line with the recent amendments to the Spanish Insolvency Act, which aims to ensure the continuity of viable businesses from an operational point of view, but not from a financial perspective, the Law 9/2015 validated the text of RDL 11/2015, but it, also, further clarified some queries raised, introduced technical improvements and modified some provisions to increase effectiveness in encouraging the achievement of refinancing agreements and the extension of their effects to dissident creditors and, likewise, favouring the sale of profitable productive units.

    Additionally, in case of failure of such measures, RDL 1/2015 (currently being processed as Bill) introduces, with varying degrees of wisdom regarding their requirements, the mechanism of second chance as an exception to the general principle of unlimited liability of the debtor.
