Resumen de El derecho a la educación en tiempos de austeridad

    El derecho a la educación tiene una doble dimensión: como libertad y como derecho social a recibir una prestación. En cuanto que derecho social, se concibe como objeto de la educación el pleno desarrollo de la personalidad, respetando los principios democráticos de convivencia y los derechos y libertades fundamentales. En coherencia con la dimensión prestacional de este derecho, suele establecerse la gratuidad y obligatoriedad de la enseñanza básica y la posibilidad de ayuda económica de los poderes públicos a los centros docentes que cumplan los requisitos previstos en la Ley.

    The right to get an education has two different dimensions: as freedom and as social right to receive a benefit. As a social law, it is conceived as the focus of the education, the full development of the personality observing the democratic principles of coexistence and the fundamental rights and liberties. According to the second dimension of this right, is usually to establish the cost-free status and legally binding of the elementary education. Moreover, it is also available the option of financial aid coming from the public authorities which comply with the requirements set forth in law. Together with the previous aspect that we have mentioned before, it is the other dimension: the right to education as freedom. The liberty of education can be organized as a basic Constitutional principle which projects on the entire legal claimants of the educational process giving way to the birth of subjective specific rights. This double dimension is gathered in international texts of Humans rights. The article of the Universal Declaration of Human Rights, after stating in paragraph 1 that "Everyone has the right to education", provides in paragraph 3 that "Parents have a prior right to choose the kind of education that shall be given to their children ".
