    La autora se refiere al lado oscuro de la justicia penal, considerando que el manejo discrecional de las leyes y acomodar su aplicación a las condiciones coyunturales del momento constituye un atentado al Estado de Derecho. No es criticable buscar la seguridad, tampoco sancionar a quienes han cometido actos ilícitos, lo criticable es utilizar la justicia penal porque en su momento no nos parece adecuada, política o socialmente, la aplicación estricta del derecho. El caso del etarra Iñaki de Juana Chaos, en España, permite reflexionar sobre diversas paradojas en la aplicación de la justicia penal.

    The author refers to the dark side of criminal justice, considering that the discretional management of the law, as well as the convenience of its application to the conditions arising from the situation of the moment, is an attack to the rule of law.

    It is not to be criticized neither looking for security nor punishing those who have done illegal acts; what is to be criticized is the use of criminal justice just because the strict application of law seems to be inadequate in a specific moment, either politically or socially. The case of the activist of ETA, Iñaki de Juana Chaos, in Spain, makes us think about several paradoxes concerning the application of criminal justice.
