Resumen de Guarda legal de personas incapaces y de hijos mayores incapacitados

  En este trabajo se reflexiona sobre la aplicación a los incapaces en situación de desamparo de las medidas de protección previstas por el artículo 172 del Código Civil para los menores, especialmente en lo referente a las distintas formas de guarda legal. Se pone para ello en relación este precepto con lo establecido en el artículo 239.3 del Código Civil, que prevé tan solo la asunción por la entidad pública por ministerio de la ley de la tutela de los incapaces cuando ninguna de las personas previstas en el artículo 234 del Código Civil sea nombrado tutor o cuando el incapaz se encuentre en situación de desamparo. Se presta especial atención a la situación del hijo incapacitado que se encuentra bajo la patria potestad rehabilitada de sus padres, utilizándose como punto de partida del trabajo una resolución judicial que acordó la remoción de la patria potestad respecto de su hijo incapacitado, asignándole como tutor una fundación.

  In this paper we examine the application of the protective measures provided for minors in article 172 of the Civil Code to incapacitated persons, especially with regard to the various forms of legal guardian. To this aim, this article is put in relation with the provisions of article 239.3 of the Civil Code, which provides only the assumption by the public entity by operation of law of the protection of these people when any of the persons referred to in article 234 of the Civil Code is appointed guardian or when they are in situation of social distress. We dedicate special attention to the situation of the incapacitated son which is under the restored parental authority of their parents. We use as starting point for the work a court decision which decides the removal of parental rights regarding their disabled son, assigning a foundation as a tutor. Though this article focuses on the regulation of the Civil Code prior to the appearance of the Law 26/2016, 28th July, which modifies the system of protection of children and teenagers, it also deals with the novelties introduced by this norm.
