  Un nuovo profilo del ne bis in idem e stato delineato dalla giurisprudenza delle Corti europee, Il presente scritto esamina i casi nei quali sono stati individuati i criteri per stabilire l'identitá del fatto che ora fa capo alle circostanze materiali, senza rilievo della qualificazione giuridica, degli e1ementi costitutivi del reato o dell'interesse tutelato dalla norma penale. Ravvisato che lo stesso metodo e stato applicato anche al divieto di doppio processo tra giudizio penale e giudizio amministrativo, non se ne riscontra la ricezione nella giurisprudenza interna in relazione all'art. 649 c.p.p, con particolare riguardo ai casi di concorso formale, La recen te questione di legittimitá costituzionale sollevata dal Giudice dell'udienza preliminare nel processo Eternit bis pendente a Torino, ha fomito l'occasione per verificare i possibili effetti della declaratoria di illegittimitá.

  The European Courts' case law has taken new steps in developing the principie of ne bis in idem, This paper discusses the rulings which set out the criteria for determining whether or not apparently different transactions result in the same fact within the meaning of Article 4, 7th Protocol to the European Convention on Human Rights. Such criteria now entail just mere facts, irrespective of the nature of the crime and of its essential elements and of the interests protected by law. The same standards are adopted in the event that a risk of double jeopardy arises between facts at issue in a criminal trial and in administrative proceedings. Italian Courts still continue to rule that there is absolutely no violation of the statutory provision that prohibits to prosecute the same individual twice for the same fact (Article 649 of the ltalian Code of Civil Procedure) when the same conduct results in various offences. Recently, in the preliminary hearing for the Eternit case, the Court of Turin raised a constitutional challenge against such provision. It will be interesting to see the consequences of a ruling from the Constitutional Court accepting the European standards.
