Nuevas fronteras del ilícito intrafamiliar en Italia

    Como fruto de la evolución social y cultural de la familia se ha ido afirmando la idea de que los remedios típicos del Derecho de Familia ya no alcanzan para disciplinar de manera exhaustiva las crisis de los vínculos conyugales y de filiación. La jurisprudencia italiana ha asì reconocido la posibilidad de configurar nuevas figuras de daño y, en particular, el daño por “ilícito intrafamiliar”. La Suprema Corte italiana ha recientemente hecho extensiva la aplicación del ilícito intrafamiliar también a la familia de hecho. Po otro lado, un debate que todavía está abierto y que, hasta ahora, no ha sido afrontado de manera exhaustiva por la jurisprudencia es la eventual responsabilidad civil del amante. Una responsabilidad extracontractual del amante es admisible, en abstracto, sobre la base de los mismos principios que permitieron la afirmación de la responsabilidad del cónyuge que comete un ilícito intrafamiliar.

    As a result of the social and cultural evolution of the family, the idea that typical family law remedies already fail to discipline conjugal ties and affiliation crises in a comprehensive manner is gaining relevance. The Italian case law has thus recognized the possibility of setting up new figures of the wrong, and, in particular, the damage caused by the "intra-family wrong". The Italian Supreme Court has recently extended the application of the intra-family wrong also to the family in fact. On the other side, a debate that is still open and that, so far, has not been addressed exhaustively by the case law is the eventual civil liability of the lover. A non-contractual liability of the lover is admissible, in theory, on the basis of the same principles that allow the claim of liability of the spouse who commits an intra-family wrong.
