A relação do homem com a natureza é assunto que, historicamente, figura como objeto de grandes discussões no cenário científico-filosófico e jurídico. Nesse sentido, o presente artigo pretende demonstrar, a partir da análise do processo de coisificação ao qual são submetidos os animais não-humanos pelo homem, por serem considerados, na visão da teoria contratualista racionalista, defendida por Rousseau e Kant, desprovidos de qualquer consideração moral, a necessidade, ante a essa contestável realidade, de reestudar-se, à luz da Teoria Científica de Thomas Kuhn, o paradigma dominante. Com esse objetivo, este estudo destaca ser relevante a ascensão de um novo paradigma de inclusão dos animais, dado o reconhecimento do valor intrínseco destes, como fruto de uma reforma ou revolução científica, defendidas, respectivamente, por Peter Singer e Tom Regan.
The relation between man and nature is a subject that historically figures as object of a lot of discussions in scientific-philosophical and legal scenario. On this way, this present article intends to show, by the analysis of the reification process to which the non-human animals are submitted by men, because they are considered in the rationalist contractualist theory, defeated by Rousseau and Kant, devoid of any moral consideration, the need, at this contestable reality, of restudy up, in light of the Scientific Theory of Thomas Kuhn, the dominant paradigm. With this objective, this article highlights to be relevant the rise of a new paradigm of inclusion of the animals on the recognition of intrinsic value of these as the result of a reform or scientific revolution, defeated, by respectively Peter Singer and Tom Regan.
