Resumen de O papel institucional do Superior Tribunal de Justiça no sistema processual e o novo código de processo civil

  As cortes superiores e, em especial, o Superior Tribunal de Justiça, gozam, no sistema jurídico vigente e à luz do novo Código de Processo Civil profunda vocação para a manutenção da ordem jurídica, agregando às suas funções a função normativa pela qual se propõe a univocidade do direito positivo, cumprindo a esses tribunais a uniformização da jurisprudência e sua estabilidade, integridade e coerência. A adoção de processos e recursos afeitos à emissão de precedentes com força vinculante decorre da exigência da sociedade e dos direitos massificados, cumprindo dar uma racionalidade às decisões judiciais, atendendo a princípios inerentes ao sistema, em especial quanto à tempestividade, efetividade e segurança jurídica dos pronunciamentos judiciais, sem que com isso reste ofendida a distinção dos poderes.

  The superior courts and in particular the Superior Court of Justice shall, within the existing legal system and in the light of the new Civil Procedure Code profound vocation for the maintenance of law, adding to its functions to rules function by which it proposes to univocity of positive law, fulfilling these courts uniformity of jurisprudence and its stability, integrity and consistency. The adoption of processes and resources accustomed to the issue of precedents with binding force flows from the requirement of society and mass market rights, fulfilling give a rationality to judicial decisions, meeting the principles inherent in the system, especially regarding the timeliness, effectiveness and legal certainty for judicial pronouncements, without thereby remains offended the distinction of powers.
