  La resolución judicial de diversos procedimientos sobre un mismo hecho, como es la construcción de una edificación, puede conllevar que los procedimientos judiciales resulten contradictorios. Así ocurre con el ya famoso hotel Algarrobico construido con licencia de obra y que se ha visto sometido a distintos conflictos judiciales. Se analizan en el presente estudio tres procesos: uno sobre la legitimidad de la licencia, otro sobre la consideración de los terrenos en el planeamiento territorial y un tercero sobre la afección a la Ley de Costas.

  Los pronunciamientos judiciales emitidos conllevan, en algunos casos, la deslegitimización de la edificación y del acto que lo autorizó y, en otros, que no resulte reproche a dicha construcción. La inseguridad jurídica está servida.

  The legal ruling of various proceedings about the same deed, such as the construction of a building, may entail inconsistent proceedings. That is the case of the famous hotel Algarrobico, which was built with a building permit and has been referred to different court actions. The purpose of this study is to analyze three procedures: The first one, about the legitimacy of the building permit; the second one, about the consideration of the land in the territorial planning, and the third one, related to the coastal law effects.

  The legal rulings may, in some cases, delegitimize both the construction of the building and the action that authorized it, and, in other cases, the construction may be considered beyond reproach. Therefore, it seems that the legal uncertainty is on the cards.
