Resumen de Su alcune voci e locuzioni giuridiche d'interesse lessicografico

Il saggio presenta una selezione di parole e locuzioni giuridiche valutate con riguardo alla presenza e al trattamento nei dizionari dell’uso e storici, nonché in estesi archivi elettronici di testi giuridici, distinti per periodo (testi antichi, moderni e contemporanei) e tipologia (testi normativi, applicativi e giurisprudenziali, dottrinali, testi della prassi). Il saggio intende così contribuire alla conoscenza del lessico giuridico e al perfezionamento delle informazioni lessicografiche. La documentazione attraverso esempi e contesti tratti dai repertori indagati consente in particolare di segnalare voci o accezioni significative non trattate dai dizionari, di proporre possibili retrodatazioni, di individuare scarti di rilievo tra definizioni presenti nei dizionari ed effettiva consistenza semantica delle voci in esame nei testi giuridici.
La diversa distribuzione delle voci tra testi normativi e testi di altro tipo, osservata attraverso minimi raffronti quantitativi, prospetta atteggiamenti di scrittura e di elaborazione del discorso giuridico di volta in volta riferibili a esigenze di denotazione tecnica o a fatti di natura espressiva. Il carattere tecnico delle voci e delle accezioni considerate o la loro relazione con abitudini scrittorie proprie del testo giuridico sono confortati da una parallela ricerca in repertori elettronici di testi della tradizione letteraria o storicoculturale italiana, quasi in ogni caso improduttiva di attestazioni utili.

The essay presents a selection of juridical words and locutions valued according to the presence and the treatment in the dictionaries of use and the historical and also, in electronic archives of legal texts, divided according to the period (ancient, modern and contemporary texts) and typology (normative, enforceability and jurisprudential, doctrinal texts and texts of accepted practice). Thus, the essay has the goal of contributing to the knowledge of the law lexicon and to the perfecting of the lexicographic information.
The documentation, through examples and contexts taken from the examined repertoires, allows underlying voices or significant meanings not examined in dictionaries, to propose possible backdating, to find relevant differences between definitions present in dictionaries and effective semantic consistency of the voices by examination of the juridical texts. The different distribution of the voices among normative texts and texts of other kind, observed through minimum quantity comparisons, reveals writing attitudes and elaboration of the juridical speech of technical or expressive nature. The technical character of the voices and the meanings or their relation with writing habits typical of law text are confronted by a parallel research in electronic repertoires of texts belonging to the Italian literary or historical-cultural tradition, in each case almost not productive for use
