Resumen de Uniones de hecho y atribución del hogar común

  El artículo 1.277 del Código Civil, norma ubicada en el Capítulo VI, del Título II del Código Civil, de carácter tuitivo del hogar conyugal, se aplica aun después de disuelta la sociedad conyugal y establece la necesidad del consentimiento de ambos esposos para disponer del inmueble ganancial o propio de uno de ellos, en que esté radicado el hogar conyugal si hubiere hijos menores o incapaces. La regla excede el aspecto meramente patrimonial, para ser analizado desde el ámbito del interés familiar. En este marco, el Art. 1.277 del Código Civil creemos se debe aplicar analógicamente al supuesto en que la custodia de los hijos menores o incapaces ha sido atribuida a uno de los progenitores con motivo de la ruptura de una unión de hecho, cuando el inmueble es de propiedad común o de uno de los convivientes. Ello con fundamento en el principio de no discriminación de los hijos, de igualdad ante la ley, en el carácter alimentario del resguardo y en la protección integral de la familia

  Article 1277, from chapter VI, title II, from Argentinean Civil Code, which protects marital home, applies even after marital society is dismissed and establishes both husband and wife have to give their consent to sell, rent or mortgage communal property or own to anyone of them, where it’d be placed marital home if there would be under age children or unable. Rule exceeds merely material aspects, to be analyzed from family interest point of view. We believe article 1277 from Civil Code, must be applied analogously to the supposition that custody of under age children or unable has been given to one of their parents, due to breakingoff of non-married couple, when both or either are property’s owners. The idea is based on the principle of non discrimination of children, equality against law, in the alimentary nature and in overall protection of the family
