The sanctioning of corporations has become everyday business for public prosecutor’s offices as well as for the authorities responsible for imposing administrative fines. Of particular interest as well as being financially profitable for the state, are trials involving antitrust violations and corruption. The central instruments for imposing monetary fines are to be found in the Administrative Offences Act as well as the confiscation rules of the German Criminal Code.The following article focusses on two subjects: violations of supervisory duties under the terms of section 130 of the Administrative Offences Act, which in practice are the most important causes of administrative fines, and confiscation orders against third party recipients according to section 73 (3) of the German Criminal Code. The first indications of the forthcoming reform of the German rules on asset recovery which is planned for the fall of 2016, will also be taken into consideration.

Die Sanktionierung von Unternehmen gehört mittlerweile zum Alltagsgeschäft von Buß- geldbehörden und Staatsanwaltschaften. Besonders schlagzeilenträchtig – und für den Staat finanziell ergiebig – sind hier Verfahren, die Kartellrechts- und Korruptionsverstöße zum Gegenstand haben. Zentrale (Haftungs-)Tatbestände finden sich dabei im OWiG und im Verfallsrecht. Im folgenden Beitrag werden konkret die Aufsichtspflichtverletzung gemäß § 130 OWiG als praktisch wichtigste Anknüpfungstat für die Verbandsgeldbuße und der Verfall zu Lasten eines Drittbegünstigten gemäß § 73 Abs. 3 StGB mitsamt ihren aktuellen Bezügen näher in den Blick genommen. Die zum Herbst 2016 anstehende Reform des Ver- mögensabschöpfungsrechts wird schon in einzelnen Hinweisen berücksichtigt.
