    Religion and Law in the Early Modern history. The devaluation ofthe canon law by Protestant Refonners promoted the system-oriented presentations of law based on Roman law. AIso in ius publicum there is a significant majority of Protestant autbors. The situation differs from naturallaw and law ofnations where the discourse ofthe 16th century was broadly detennined by Catholic authors, specifically by the so called Spanish late scholasticism. In the Spanish empire fundamental works on naturallaw and law ofnations were created. This carne to an end in consequence of a "re-theologisation" of the judicial discourse in the Jesuit led Tridentine Counter- Refonnation.     Im 16. Jahrbundert beforderte die refonnatorische Abwertung des kanonischen Rechts die Abfassung systematiscber, auf dem romischen Recht beruhender Darstellungen des Rechts. Aucb im Bereicb des ius publicum lasst sicb ein deutliches Übergewicbt protestantischer Autoren feststellen. Anders verhalt es' sich auf dem Gebiet des Natur- und Volkerrechts. Hier wurde der Diskurs im 16. Jahrhundert weitgehend von katholischen Autoren bestimmt, insbesondere aus dem Bereich der sog. spanischen Spátscholastik. Vor dem Hintergrund des spanischen Weltreiches entstanden grundlegende Werke zum Natur- und Volkerrecht. [m Bereich der von den Jesuiten geführten tridentinischen Re-Fonnierung des Katholizismus kam es zu einer Retheologisierung dieser Entwürfe. [m 17. Jahrhundert sind es dann, beginnend mit Hugo Grotius, vornehmlich protestantische Autoren, welcbe die einschlagigen Werke verfassen
