Resumen de Klaus Günther e a nova perspectiva sobre a teoria da argumentação: justificação e aplicação

This article aims to reconstruct the main ideas presented by Günther in his book Der Sinn für Angemessenheit: Anwendungsdiskurse in Moral und Recht. In this book, the philosopher shows that there are two types of discourse, namely, the discourse of justification and the discourse of application. The First part of the universal principle “U” – already known of discourse ethics. Its function is justified by consideration of all the interests involved. For Günther, the mistake of the discourse of justification was to understand the validity of a norm as containing each of its application situations. On the other hand, the discourse of application aims to consider the particularities of the situation in order to determine which norm is most appropriate for the context in question.

O presente artigo visa a apresentar, dialogar e também levantar algumas críticas à teoria da argumentação de Günther. O jusfilósofo demonstra que há dois tipos de discurso, a saber, o discurso de justificação e o discurso de aplicação. O discurso de justificação parte do princípio universal “U” – já conhecido da ética do discurso. Sua função é a justificação por meio da consideração de todos os interesses envolvidos. Segundo Günther, o engano do discurso de justificação foi entender a validade de uma norma como contendo cada uma das suas situações de aplicação. Por sua vez, o discurso de aplicação tem por objetivo considerar as particularidades da situação, a fim de verificar qual norma é a mais adequada para o contexto em questão.
