  • The article reports that a final rule has been adopted by the U.S. Commodity Futures Trading Commission (CFTC) for applying its uncleared swap margin requirements in cross-border transactions. CFTC's final rule lays out when CFTC margin rules will apply and the extent to which they will apply to cross border swaps. James Schwartz, counsel at Morrison & Foerster, said the CFTC has opted for an elements-based approach rather than a holistic regime
