    La actualidad mundial de la migración ha dado como resultado que se le denomine como “era de la migración”; bajo ese contexto, todas las regiones del mundo, y los países en lo individual, han emprendido acciones con miras a dos cuestiones fundamentales: la primera, contener en la práctica y proteger formalmente a las personas compelidas a migrar y la segunda, ejercer efectivamente su dominio jurídico sobre los flujos migratorios que ellas han formado. A nivel internacional, el discurso actual identifica a la migración como un fenómeno incontenible e irreversible, que además se vincula estrechamente con el desarrollo y trata de combatir la idea de ser una amenaza, una catástrofe o una emergencia.

    Due to the increasingly migration fluxes, nowadays we live in the so called “migration era”, on that context, all world regions and the countries by themselves, have taken action toward two essential matters: first, contain in practice and protect in the law migrating people and the second, effectively exercise its legal control over migration flows they have formed. Internationally, the current discourse identifies migration as an unstoppable and irreversible phenomenon, which also is closely related to the development and tries to fight the idea of being a threat, a disaster or an emergency.
