  Este artículo habla de la responsabilidad civil subsidiraria, derivada del delito de Estado, haciendo un recorrido por su evolución histórica. En esta evolución, hace especial hincapié en el procedimiento de declaración subsidiaria del Estado en el Código de Justicia Militar de 1945 y también en el Código Penal Militar de 1985. Asimismo incide en los requisitos para la declaración de la responsabilidad subsidiaria del Estado en el régimen jurídico vigente, en el procedimiento para hacer efectiva la responsabilidad subsidiaria del Estado y en la Compatibilidad de las indemnizaciones y resarcimientos.

  This article deals with residual civil liability derived from crimes of State, explaining its historical evolution. This essay highlights the State’s residual declaratoin procedure included in the 1945 Military Justice Code (Código de Justicia Militar) as well as in the 1985 Military Criminal Code (Código Penal Militar). It also focuses on the requirements needed for the declaration of the State’s residual liability within current legislation, on the existing procedure to give effect to the State’s residual liability and the Compatibility of compensations and damages.
