The ruling is the first in the legitimacy of the question concerning the possibility to be confiscated and, therefore, the seizure prior to this function, assets have been transferred in trust. When the constitution of the trust is a mere ploy to create a legal barrier between personal wealth and property comprising the trust, the assets of the suspect may be subjected to a real bond, because of the special regime that has taken such a legal transaction in this case, since the establishment of the trust occurred in fraud of creditors, must be counted among them, the state treasury to the credit, the State. The decision, then, faces the additional problem concerning the legitimacy of the trustee to bring the request for review, excluding such a possibility if he is acting to protect the ownership of assets transferred in trust, but transferred to third parties.
La sentenza costituisce il primo approdo in sede di legittimità della questione relativa alla possibilità di sottoporre a confisca e, quindi, al sequestro preventivo funzionale ad essa, beni che siano stati conferiti in trust. Allorché la costituzione del trust costituisca un mero espediente giuridico per creare un diaframma tra patrimonio personale e proprietà costituita in trust, i beni dell’indagato possono essere sottoposti a vincolo reale, in ragione del peculiare regime che tale negozio giuridico ha assunto nel caso concreto, essendo la costituzione del trust avvenuta in frode ai creditori, tra i quali va annoverato, quanto al credito erariale, lo Stato. La decisione, poi, affronta l’ulteriore problema relativo alla legittimazione del trustee a proporre la richiesta di riesame, escludendo una tale facoltà nel caso in cui costui agisca a tutela della proprietà di beni conferiti in trust ma ceduti a terzi.
