La Corte di cassazione, in riferimento all’art. 7 Cedu, si divide sulla questione di legittimità costituzionale della disciplina transitoria introdotta dalla l. 5 dicembre 2005 n. 251, laddove prevede che i termini di prescrizione più favorevoli si applicano solo ai giudizi pendenti in primo grado, in deroga al principio di retroattività della lex mitior. Ma il ruolo “interposto” della disciplina pattizia non muta – così dice la Corte costituzionale – anche dopo il Trattato di Lisbona e il problema, di difficile soluzione, va affrontato alla luce dell’art. 117 Cost.
The constitutionality of the Law n. 251/2005 is a controversial matter. It is not clear yet in the decisions of the Court of Cassation whether the provisions related to the statute of limitations for crimes are compatible with the interpretation of art. 7 of the European Convention of Human Rights and Fundamental Freedoms provided by the European Court of Human Rights, or not. Undoubtedly the issue is very complex and has to be faced in the perspective of art. 117 of the Italian Constitution.
