Tipo, ilícito e valor: notas conceituais e sistemáticas

    The Tatbestand (actus reus) and Unrecht (wrongdoing) concepts should not be confused. However, in material terms, Tatbestand and Unrecht enjoy the same basis and the same function, constituting a unit, a single systematic category: Unrechtstatbestand. A category which, if properly understood, proposes a reversal of perspective on the old controversy surrounding the ratio cognoscendi and the ratio essendi theories: it is not (and it should not be) the Tatbestand the ratio essendi of the Unrecht, but its exact opposite. It is the Unrecht the ratio essendi of the Tatbestand; it is the Unrecht the reason of the Tatbestand, its foundation. From this assertive important consequences in terms of attribution and delimitation of the Tatbestand, in the strict sense, arise.

    Os conceitos de tipo e ilícito não se confundem. Todavia, em termos materiais, tipo e ilícito desfrutam do mesmo fundamento e da mesma função, constituindo uma unidade, uma única categoria sistemática: o ilícito-típico. Categoria essa que, se adequadamente compreendida, propõe uma inversão de perspectiva sobre a antiga controvérsia em torno das teorias indiciária (ratio cognoscendi) ou fundamentadora (ratio essendi) da ilicitude: não é (e não deve ser) o tipo a ratio essendi da ilicitude, mas sim o seu exato oposto. É a ilicitude a ratio essendi da tipicidade; é o ilícito a razão de ser do tipo, o seu fundamento. Assertiva da qual advêm importantes consequências em termos de imputação e de delimitação do tipo em sentido estrito.
