  • Localizing jurisdiction on the Internet is not an impossible endeavor. It requires not to endorse a technical approach based on the universality of the medium. Internet is just a mean of communication for mankind. The activity should prevail over the tool. The solution would be to circumvent the tool in the process of localization. Such a process should take into account real people using in real life the Internet. Finally, what counts on the Internet should be the residence of the person posting content on the network, the residence of the person suffering from the content and the residence of the public. Jurisdiction on the Internet requires crossing the "smoke of screen" created by the Internet, in order to localize the activity.
