    Los deportistas profesionales por cuenta ajena son sujetos de una relación laboral, ya que prestan sus servicios en régimen de dependencia y dentro del ámbito de organización y dirección de un club o entidad deportiva. Por tanto, y dado que su normativa reguladora reconoce el derecho a la seguridad y salud, se les aplica la normativa preventiva en todo lo que no entre en contradicción con su norma específica. A ello unimos las prescripciones que en la materia contengan los convenios colectivos, los cuales pueden ampliar y complementar lo dispuesto en las normas legales. Para el cumplimiento de sus obligaciones preventivas, el empresario debe observar las prescripciones que marca la Ley de Prevención de Riesgos Laborales con el objeto de hacer una buena gestión de los riesgos a que está expuesto el deportista, mediante la planificación de las acciones necesarias para eliminarlos o minimizarlos.

Therefore, and given the fact that their regulatory policies acknowledges their right to safety and health, and the preventive policies are applied to them without contradicting their specific regulations. In addition to this, we should add the requirements that their specific collective agreements state, which could expand and complement what the legal regulations describe. As to comply with their preventive obligations, the businessman must observe the prescriptions stated in the Labour Risk Law, with the aim of making a good management of the risks that the sportsman is facing, through the planning of the needed action as to eliminate or minimize them.
