    • This contribution deals first with the conditions under Swiss law for the provisional application of treaties: urgency of application, Switzerland's essential interests, 6 months to submit the treaty to Parliament and newly, following a recent debate, no veto from the parliamentary commitees. Hence the issue whether the provisional application has to remain a governmental competence or may be conceived as a parliamentary prerogative of accelerated provisional approval is discussed.

      Te text then deals with the legal effects of provisionally applied treaties, the limits to a partial provisional application and the relevance of several provisions of the 1969 Vienna Convention on the law of treaties in this regard. Based on examples, it finally makes proposals to better govern, with express clauses or presumptions, the termination of provisional application.
