El trabajo ofrece un panorama de la situación jurídica actual de las aguas subterráneas en Chile, describiendo las principales reglas del Derecho vigente. Se divide en tres apartados: el primero, destinado a una contextualización general de la normativa, destacando sus hitos centrales en textos históricos y contemporáneos; el segundo, dirigido a identificar las figuras e instituciones que el régimen en vigor contempla; y, el tercero, enfocado a la enunciación de algunas novedades que pueden advertirse en el Decreto N° 203, de 2014, que aprueba el Reglamento sobre normas de exploración y explotación de aguas subterráneas.

The present article offers a broad view of the actual legal situation in Chile concerning underground waters, describing the main rules of law in force. This work is divided into three sections: the first one attempts to give a general context of the regulation that governs the use of underground waters, highlighting its main accomplishments based on historical and contemporary texts; the second, aims to identify the institutions established by this regulation; and, the third one, focuses on the enunciation of some novelties that can be appreciated in the Decree N° 203, of 2014, which approves rules of exploration and exploitation of underground waters.
