El objeto de este trabajo es proponer que la noción de derecho objetivo condiciona nuestro entendimiento del abuso del derecho. Para lo anterior, es importante la distinción entre uso y abuso en el ejercicio de un derecho y el carácter relativo de este último. Al desarrollo de estos puntos nos abocaremos en primer término. Seguido a ello, se mencionarán algunas de las principales visiones sobre el derecho objetivo, identificando las maneras como ellas impactan en las doctrinas del abuso del derecho. Finalmente, destacaremos su origen en el derecho privado y las consecuencias prácticas y operativas que de esto se derivarían.

The purpose of this paper is to propose that the notion of objective rights conditions how we understand the concept of an abusive exercise of rights. In order to do achieve this goal, it is important to keep in mind the distinction between an exercise and an abusive exercise of a right and the relative nature of the latter. We will devote the first part of our analysis to this initial topic. Afterwards, we review the main visions on objective rights, identifying how they, in turn, have an impact on the different doctrines on abusive exercise of a right. Finally, we will address its origin in private law and the practical and operative consequences which derived from this fact.
