    En el presente artículo se aborda un estudio histórico sobre la evolución de la potestad sancionadora administrativa en Alemania, donde las denominadas “contravenciones” han alcanzado una sustantividad propia en la denominada “Gesetz über Ordnungswidrigkeiten”, abreviada como OWiG, cuya redacción vigente pretende sistematizarse también en este trabajo. El modelo alemán y el estudio de sus previsiones legales parecen dignos de tenerse en cuenta en un país como España, carente de una norma que regule la teoría general de la potestad sancionadora administrativa y donde, por tanto, dicha teoría general tendrá que seguir construyéndose jurisprudencialmente, con la dificultad e inseguridad jurídica que, de forma previsible, provocará la generalización de soluciones que tienen como fundamento el caso concreto.

    In this paper a historical study on the evolution of sanctioning administrative power in Germany, where the so-called "violations" have reached a substantivity itself in the so-called "Gesetz über Ordnungswidrigkeiten", abbreviated OWiG addressed, the current wording intended also systematized in this work. The German model and study its legal provisions seem worthy to be taken into account in a country like Spain, lacking a rule governing the general theory of sanctioning administrative power and where, therefore, that general theory will have to continue to build jurisprudencialmente with the difficulties and legal uncertainty, predictably, will lead to the generalization of solutions that are based the case
