Resumen de A proteção concedida pela previdência social brasileira à incapacidade laboral

  O presente trabalho tem por objetivo apresentar a proteção social concedida pelo Regime Geral de Previdência Social Brasileiro à incapacidade laboral. Para tanto serão feitas breves considerações sobre as principais características da seguridade social, sistema no qual está inserida a proteção previdenciária. Na sequência, será abordada a previdência social brasileira e suas subdivisões, demonstrando que todos os trabalhadores estão vinculados obrigatoriamente à proteção previdenciária, ou no Regime Geral ou nos Regimes dos Servidores Públicos. Por fim, será tratada a proteção concedida à incapacidade laboral, a partir das disposições infraconstitucionais relativas as três espécies de benefícios concedidos ao citado risco, bem como será verificada sua adequação às diretrizes constitucionais, especialmente no que tange ao primado do trabalho.

  The objective of this study is to analyze the social protection concede by the Regime Geral de Previdência Social Brasileiro (Brazilian General Social Security Regime – free translation) to incapacity to work. Therefore, it shall be made brief considerations on the main characteristics of the social security, a system in which is inserted the social security protection. Subsequently, the Brazilian social security and its subdivisions shall be addressed, demonstrating that all workers are obligatorily linked to the social security, either in the General Regime or in the Government Officers Regime. Finally, the conceded protection to the incapacity to work shall be also addressed, from the sub constitutional legislation related to the three species of the benefits conceded to the mentioned risk, as well as the addressing of its adequacy to the constitutional guidelines, especially in the primacy of work.
