  Uma concepção de cidadania historicamente situada só adquire potencial heurístico se e na medida em que reconhecer indivíduos reais, em suas condições materiais de vida e a defesa de seus direitos fundamentais na condição de direitos humanos de toda humanidade e não apenas enquanto promessas formais e sim como fatores que demandam serem concretizados. Com isso, compreender o fenômeno jurídico, numa perspectiva que dê conta da premência de materializar direitos, implica em perceber que seu ponto de partida não pode se limitar ao sujeito imaginado pela concepção liberal oitocentista porque o direito contemporâneo não pode prescindir de ter em conta novos contextos resultantes das imensas transformações ocorridas no século XX e em curso neste século XXI.

  A conception of citizenship historically situated only acquires heuristic potential if recognizes real individuals in their material conditions of life and the defense of their fundamental rights in the condition of human rights of all humanity and not only as formal promises but as factors that demand to be fulfilled.
