The text will deal with the new rules that limit public spending and which were introduced by the 95th Constitutional Amendment, published on December 15th, 2016. The amendments, which aim to limit public spending, reach the minimum percentages resources due to maintenance and development of education, stablished by the Constitution of 1988 since its promulgation. The matter relevance lies in its actuality and in the need to visualize prevention measures of the negative impacts that will certainly be produced on the state actions aimed to achieving the educational goals established both nationally (in the National Education Plan) and in the international commitments signed by Brazil.

O texto tratará as novas regras que limitam as despesas públicas e que foram introduzidas pela Emenda Constitucional 95 de 15 de dezembro de 2016. As alterações, que tem por objetivo limitar os gastos públicos, atingem os percentuais mínimos de direcionamento dos recursos financeiros orçamentários para as despesas de manutenção e desenvolvimento do ensino, previstos pela Constituição de 1988 desde a sua promulgação. A relevância do tema está na atualidade e necessidade de visualizar medidas de prevenção dos impactos negativos que, certamente, produzirá nas ações estatais voltadas ao cumprimento das metas educacionais estabelecidas tanto nacionalmente (no Plano Nacional da Educação) quanto nos compromissos internacionais firmados pelo Brasil.
