Earthjustice's letter was sent to DEC commissioner Joe Mertens after the body announced its intention to publish a draft temporary revocable permit which allows NYCO to proceed with mineral sampling in Adirondack Forest Preserve, US.
The law firm also asks DEC to "fulfil its obligations under all of those unaltered, non-constitutional provisions before permitting NYCO to conduct any minerals sampling operations in Lot 8." "NYCO has responsibly mined wollastonite on a privately owned portion of the Adirondack Park under state permits for more than 60 years, and is committed to abiding by all applicable laws and regulations when moving forward with the land swap process," [John Brodt] said.
