Resumen de As finalidades ocultas do sistema penal

  Buscou-se sempre extinguir ou diminuir a criminalidade. Após tomar para si o poder de punir, o Estado declarou finalidades a serem cumpridas pelas suas sanções, atualmente adotando a Teoria Mista, pela qual a pena visa punir e ressocializar o condenado. Contudo, essas finalidades oficiais não vêm demonstrando resultados satisfatórios. Observando a realidade fática, através de análise de dados oficiais, percebe-se que existem finalidades ocultas no sistema penal, materializando-se no controle social, na violência institucional e na manutenção das desigualdades sociais acentuadas. Dessa forma, visa-se demonstrar que essas finalidades, em realidade, sustentam o atual sistema econômico – Sistema de Produção Capitalista –, não tendo como referência melhores modelos de prevenção e repressão ao crime, e há grande prejudicialidade na sua existência para toda a sociedade.

  It has always been searched for ways to wipe out or to reduce the criminality. After taking upon itself the power to punish, the state declared some purposes to be fulfilled by its regulations, currently adopting the Mixed Theory, by which penalty aims punishment and rehabilitation of condemned. However, these official purposes have not demonstrated satisfactory results. Observing the reality, through analysis of official datas, it possible to verify that there are hidden purposes in the penal system, materializing in social control, institutional violence and maintenance of social inequalities. Thus, it is aimed to demonstrate that theses purposes, in reality, have for objective of sustain the current economic system – Capitalist’s Production System –, not having as reference better models of crime’s prevention and repression, and there is a high loss in its existence for society.
