Judiciary practices, property rights and class attitudes. The 18th century Catalonian example. -- This article dwells on the origins of the modern concept of property. This analysis of 18th century judicial practices in matters of property rights in two neighboring rural areas in Catalonia (Empordà and Roussillon) highlights the abuses committed by a minority of wealthy owners against the rest of the population. This study refers to research by English academics who relativize the economic importance of enclosures and emphasize the social problems inherent in any change affecting customary uses of the land.

Cet article propose une réflexion sur les origines du concept moderne de la propriété. Analysant les pratiques judiciaires relatives aux droits de propriété, au XVIIIe siècle, dans deux régions voisines du monde rural catalan, l'Empordà et le Roussillon, l'auteur souligne les abus imposés par une minorité de riches propriétaires à l'ensemble de la population. Cette contribution renvoie aux travaux de chercheurs anglais qui relativisent l'importance économique des enclosures et mettent l'accent sur la problématique sociale inhérente à tout changement ayant trait aux usages fonciers.
