La ITSS en el País Vasco: una experiencia de colaboración entre Administraciones

    El sistema de Inspección de Trabajo y Seguridad Social (ITSS) español es plural, pues en Cataluña y País Vasco coexisten una Inspección estatal con las correspondientes Inspecciones autonómicas. El artículo comienza explicando el proceso de transferencia, que, en el caso de Euskadi, culminó con el Real Decreto 895/2011, de 24 de junio y el Convenio de Colaboración suscrito el 14 de diciembre de 2011 entre la Administración General del Estado (AGE) y el Gobierno Vasco (GOVA).

    El traspaso a estas Comunidades Autónomas ha sido relativamente parcial, dado que no han recibido la totalidad de la ITSS. El reparto de competencias socio-laborales entre la AGE y las CC.AA. determina que cada una de las Inspecciones se centre, con carácter prioritario, en sus ámbitos de actuación respectivos, sin perjuicio de los principios generales que rigen las relaciones entre las Administraciones implicadas: concepción única e integral, colaboración, coordinación y cooperación recíprocas. Por otro lado, los Cuerpos de Inspección –Inspectores y Subinspectores– conservan la plenitud de sus facultades, al margen de cuál sea su pertenencia orgánica.

    Desde esta perspectiva, buena parte del artículo se dedica a exponer el entramado institucional a través del cual se articula la relación AGE-GOVA, en materia de ITSS: se analizan las funciones y estructura del Consejo Vasco de la ITSS, como órgano de cooperación bilateral, concebido para facilitar el funcionamiento integrado y coordinado de ambas Administraciones. Además, la experiencia acumulada desde 2011, permite desgranar los primeros acuerdos alcanzados en su seno por ambas Administraciones.

    A continuación, se explica el encaje del modelo vasco de cooperación/coordinación en el sistema diseñado por la reciente Ley 23/2015, de 21 de julio, Ordenadora del Sistema de Inspección de Trabajo y Seguridad Social, otorgando especial relevancia al triple cauce de participación que esta norma facilita a las Comunidades Autónomas con traspaso:

    - General: formando parte del Consejo Rector del futuro organismo autónomo estatal.

    - Bilateral: Consejo Vasco de la ITSS.

    - Multilateral: órgano tripartito, participado por la AGE, Cataluña y País Vasco.

    The Spanish system of Inspection of Labour and Social Security (ITSS) is diverse, as In Catalonia and the Basque Country the state Inspection coexists with the corresponding autonomous inspection. The article begins by explaining the transfer process, which, In the case of Euskadi, concluded with the Royal Decree 895/2011 of 24 June and the Cooperation Agreement signed on 14 December 2011 between the General State Administration (AGE) and the Basque Government (GOVA).

    The transfer to these autonomous regions has been relatively partial, since they have not received all the ITSS. The distribution of social and labour competences between the AGE and the Autonomous Regions states that each of the inspections will focus, as a priority, in the respective fields of action, without prejudice to the general principles governing the relations between the Administrations concerned: unique and comprehensive concept, cooperation, coordination and mutual cooperation. On the other hand, the Inspection Bodies –Inspectors and Deputy Inspectors– keep their full powers, regardless of which Organ they belong to.

    From this point of view, a great deal of the article is devoted to explain the institutional framework through which the relationship AGE-GOVA is built in terms of ITSS: this article analyses the functions and structure of the Basque Council of ITSS, as an organ of bilateral cooperation, designed to facilitate the integrated and coordinated operation of both Administrations. In addition, the experience gained since 2011, allows to take advantage of the first achievements, thanks to the joint efforts of the State Inspection and the Autonomous Basque Inspection, agreements on access to information, one-stop shop, location of public offices, basic collaboration in each Province and staff training.

    Next, the article explains the engagement of the Basque model of cooperation / coordination in the system designed by recent Law 23/2015, of July 21 about ordering the System of Labour and Social Security Inspection and stressing the triple channel of participation that this regulation provides to the Autonomous Regions which present:

    – Global transfer of competences: being part of the Governing Council of the future state autonomous body.

    – Bilateral: Basque Council of ITSS.

    – Multilateral: tripartite body, integrated by AGE, Catalonia and the Basque Country.

    Finally, the article points out the main challenges in eGovernment raised with the ITSS in the Basque Country about the entry into force of Law 39/2015, of October 1, Common Administrative Procedure of Public Administrations within a bilateral context in which two Inspection bodies are offering their services to citizens.
