The paper deals with the analysis of the manumissio testamento as a complex juridical fact with progressive formation. Thorough scrutiny is applied in respect of a doctrine under which the manumissio testamento commited to a creditor's detriment (fraus creditori) is simply inefficient and rescindable upon the creditor's request, whereas the prevailing doctrine considers it null and void.
