The Article outlines the institution of gift law, whatever each legal system has chosen to include within its scope, in order to explain the origin of this area of German law. By taking a historical approach, the article points out the necessity of deferring precisely between the German legal term of gift ("Schenkung") and the roman term of donatio, referring to the German Jurist Savigny who had already remarked that the meaning of donatio has to be limited or extended with respect to the common meaning given to that term. Based on this historical point of view, the article discusses the legal nature, the formal requirements and other provisions of the German gift law.
