The principle of transparency obliges public authorities to provide accessible, accurate and comprehensible information, but the concrete obligations derived from the principle vary significantly with regard to whom information should be communicated to, the specific information concerned, and when access should be provided. An instrumental approach to transparency can open the door to a systematic understanding of transparency in EU law: The reasons behind a given obligation and the manner in which transparency contributes to the realization of legally recognized goals will determine the answer to these questions. It will also help determine whether information should be provided spontaneously or upon request, whether exceptions are justifiable, and if and how transparency can be reconciled with competing interests. In addition, it allows informed debate about the desirability of transferring transparency obligations that are recognized in a particular area of EU law to different fields, or to national jurisdictions.

Le principe de transparence oblige les autorités publiques à prévoir une information accessible, exacte et compréhensible, mais les obligations concrètes dérivées du principe varient substantiellement selon le destinataire de l'information, l'information concernée et le moment où l'accès devrait être accordé. Une approche instrumentale de la transparence peut ouvrir la voie à une compréhension systématique de la transparence en droit communautaire: les raisons d'une obligation donnée et la manière dont la transparence contribue à la réalisation d'objectifs légalement reconnus détermineront la réponse à ces questions.
