En este ensayo, el autor analiza detenidamente la legitimación de la función judicial, desde la mirada de un jurista penal. Para ello, estudia detalladamente, y critica, el discurso que procura encontrar tal legitimación en el llamado "principio democrático". Finalmente, el jurista propone otra justificación del rol de los jueces, vinculada con la sujeción incondicionada a la ley.

In this essay, the author analyses meticulously the legitimization of the judicial function, from the look of a penal jurist. With this purpose in mind, the writer studies in detail, and criticizes, the speech that tries to find such legitimization in the so called “democratic principle”. Finally, the jurist proposes another justification of the role of the judges, linked with the unconditional subordination to the law.
