    El presente trabajo aborda el estudio de toda la jurisprudencia del Tribunal Europeo de Derechos Humanos en materia de gestación por sustitución y su influencia en la jurisprudencia española. Además, se incide en la normativa de los diferentes estados que han recibido sentencias condenatorias, relacionadas con la gestación por sustitución, con la finalidad de poder determinar las disposiciones normativas que han impedido su aplicación social efectiva. Para terminar, trato la cuestión de lege ferenda, al considerar urgente su regulación, no solo a nivel nacional sino europeo, y evitar el vacío normativo existente a día de hoy.

    This paper deals with the study of all the case law of the European Court of Human Rights in the area of gestation by substitution (surrogacy) and its influence on the Spanish case law. In addition, it deepens its review on the rules of the different states that have received convictions, related to the gestation by substitution, in order to determine the policy provisions that have impeded its effective social application. In conclusion, the question of the lege ferenda, whose regulation is considered urgent, is examined, not only at the National level, but also European level, to prevent the legal vacuum that exists up to now.
