  In this article the author investigates the content of fundamental rights, in particular their genesis. The hypothesis is that the content of the rights arises in real or metaphorical dreams and is affirmed in ideals that are brought before a careful legislator with social issues and assume the rank of rights of legal texts. The dream requires not only the formal equality of human beings, but it goes further towards substantive equality.

  In questo articolo l’autore indaga il contenuto dei diritti fondamentali, in particolare la loro genesi. L’ipotesi formulata è che il contenuto dei diritti nasca nei sogni reali o metaforici, si affermi in ideali che sono portati dinnanzi ad un attento legislatore con istanze sociali e assumono il rango di diritti su testi normativi. Il sogno non esige solo l’uguaglianza formale degli individui, ma va oltre verso l’uguaglianza sostanziale.
