"FDA established the conditions under which TiO[subscript]2 can safely be used, which are laid out in the authorising regulation. FDA isn't aware of new studies assessing the safety of TiO[subscript]2 for use in foods in conformance with the regulation that would cause FDA to reconsider its safety determination," the administration told IM.
"The FDA has not issued regulations for nanomaterials in food, therefore regulations governing TiO[subscript]2 in its normal size are not applicable to TiO[subscript]2 containing intentionally manufactured nanoparticles. Nor has any petition involving TiO[subscript]2 with nanomaterials been approved," a spokesperson for the organisation told IM.
"The ingredient used in our powdered doughnuts does not meet the definition of 'nanomaterial' as outlined under FDA guidance," [Dunkin]'s [Karen Raskopf] said. "Nevertheless, we began testing alternative formulations for this product in 2014 and we are in the process of rolling out a solution to the system that does not contain TiO[subscript]2."
