    El andamiaje conceptual y procedimental del Derecho Penal se ha construido sobre la base de un esencialismo; el hombre es libre y por tanto es responsable de sus acciones. Problematizar dicha afirmación a través de una revisión de la emergencia de los enunciados que validaron entender aeste como un ser dotado de discernimiento utilizando algunas críticas de Michel Foucault al Humanismo, permite cuestionar saberes y prácticas hegemónicos del Derecho como primer estadio de un ejercicio crítico imprescindible al interior de este campo disciplinar.

    The conceptual and procedural framework of the Criminal Law has been built over the basics of essentialism, which means the man is free, therefore responsible of his own actions. To ponder about that assertion through the revision of the statements that validated his understanding as a discernment-gifted being, using some criticism of Michel Foucault to the humanism, gives the opportunity to question about hegemonic knowledge and practices in Law; being this the first stage of a critical exercise, essential within this field.
