  • Trotz einer langjährigen Rechtsprechung des EuGH zum Tatbestandsmerkmal der aufeinander abgestimmten Verhaltensweise in Art. 101 Abs. 1 AEUV – und Schrifttum hierzu – erscheint diese Form der Tathandlung dogmatisch noch nicht hinreichend scharf. Der folgende Beitrag analysiert deshalb Rechtsprechung und Schrifttum hierzu und entwickelt einen eigenen Ansatz insbesondere zur Abgrenzung von der Tathandlung der Vereinbarung in Art. 101 Abs. 1 AEUV.

    Concerned practices and prohibition of cartels Concerted practice means that at least two persons express their will and thereby achieve a mutual understanding as a result. Whether and, if so, to what extent two concurring expressions of will exist has to be determined by interpretation, which require a case-by-case analysis. In this connection it is essential how an average, circumspect, objective entrepreneur understands the statement of the adressee of the norm.

    Same as in the cases of an agreement and a decision, it is insignificant to the concerted practive itself, what content it aimes at. In particular, it does not have to deal with market behavior. This is only essential, when it comes to the restriction of competition.
