El recargo de prestaciones de la Seguridad Social constituye aspecto clave de nuestro sistema de protección social al constituir respuesta útil y eficaz en la reparación del daría producido por accidente de trabajo y enfermedad profesional. Su naturaleza compleja viene determinando un tratamiento equívoco y confuso que podría evitarse si la Administración Pública asumiera su propia responsabilidad con superación del viejo modelo ceñido a la persona del empresario infractor. Esta propuesta toma por fundamento el papel de vigilancia y garantía en la seguridad y salud laborales que le corresponde y encuentra sus en la teoría del hecho ajeno, el concepto de dependencia y el compromiso público como síntesis para, finalmente, derivar hacia el entorno de la responsabilidad patrimonial del Estado que vendría a simplificar su mecanismo y dinámica como paso previo a su definitiva ordenación.

The benefits surcharge element of Spanish Social Security is a key aspect of our system of social protection, and is a useful and effective answer with respect to compensation for the damages produced by an accident at work and work-related illness. Its complexity has led to errors and confusíon In its applícation whích could be avoided if publíc administration assumes its responsibility and surpasses the old model which centers on the offending employer. This proposal takes as its basís the State's role in the security and the guarantee of and health at work, and bases its key premises on the synthesis of the theory of tnird party-over actions, the concept of dependency and of public commitment in order to finally focus on the area of the 5tate's patrimonial responsibility, thus simplifying its mechanism and dynamics as a prelíminary step to a definitive regulatíon.
