El presente trabajo es una reflexión amplia sobre los elementos que deben caracterizar el diseño de una política migratoria adaptada al actual mundo global y, especialmente, a la relación entre América Latina y la Unión Europea en el contexto de las migraciones y el desarrollo. Entre los elementos indispensables, se encuentra la cooperación internacional, el codesarrollo entre los países de origen y destino, lograr políticas migratorias bidireccionales que favorezcan la migración legal, el pleno respeto de los derechos humanos y conseguir una adecuada integración e inclusión en el país de destino.
En este estudio se analizan los principales retos, entre ambas regiones, a los que deben hacer frente el diseño de las políticas migratorias entre el país o regiones de destino y el país o región de origen. Se destaca la relevancia de abordar con garantías la reducción de los efectos negativos de las migraciones irregulares y potenciar los efectos positivos de los procesos migratorios. Todos los Estados, tanto de origen como de destino, deben reflexionar sobre qué marco legal y qué políticas deben implementar para garantizar una política migratoria coherente y eficaz, como logro que puede contribuir en paralelo a fomentar el desarrollo de los países implicados.
En este sentido, se plantea como objetivo central a grosso modo: el análisis entre la migración y el desarrollo en la agenda política euro-latinoamericana. En el epicentro de la agenda se debe defender que en la elaboración de las políticas migratorias se tengan presentes los derechos humanos y se salvaguarden las garantías que debe tener la migración internacional desde un enfoque de Derechos Humanos.
El presente análisis parte de una aproximación general del alcance del fenómeno migratorio a nivel global, la migración internacional como fenómeno y su dinámica en un mundo global. La Unión Europea frente al evidente avance de la migración es consciente de la necesidad de regular estos flujos basándose en los principios de responsabilidad y solidaridad, más justa y humana, entre Latinoamérica y Europa.
Para poder ser consciente del alcance del fenómeno migratorio entre ambos continentes, se aborda en otro apartado, el alcance del fenómeno migratorio a nivel de América Latina y Caribe, siendo una de las regiones que vive con bastante intensidad la migración. En el caso de Colombia, la falta de oportunidades, la desigualdad, la violencia interna, son uno de los factores que han obligado a emigrar forzadamente. No obstante, se demuestra un claro cambio de flujos migratorios, según el informe del Organización Internacional de las Migraciones de 2015, en el que se destaca que la migración Norte-Sur a raíz de la crisis económica sufrida en la UE, ha generado un movimiento de retorno de nacionales de origen Latinoamericano y, en paralelo, un movimiento de inmigración circular de nacionales de estados miembros de la UE en búsqueda de oportunidades laborales en América Latina.
La tercera parte de análisis, se propone perfilar la agenda de la Unión Europea en Cooperación al Desarrollo con América Latina y Caribe (ALC), especialmente, en el caso colombiano. La Unión Europea tiene el compromiso de incorporar e integrar los derechos humanos en la cooperación para el desarrollo, siendo considerada por Colombia como un socio clave para contribuir a su desarrollo económico y social. Para lograr dicho objetivo principal, se desarrollan los acuerdos marco de colaboración entre Unión Europea y América Latina, permitiendo ejecutar proyectos que beneficien ambas partes, siempre y cuando se respete y garantice los derechos humanos.
Concordante con lo anterior, se hace hincapié en la relevancia de la Cooperación y Desarrollo en la Migración, y su especial incidencia en el caso colombiano. La importancia de la conexión entre migración y desarrollo requiere de una reflexión. Para ello, se parte de las diferentes perspectivas que se dan a partir de la decisión de migrar y que se pueden estudiar desde diferentes factores generales (económicos, sociales, etc.). En ese sentido, se destaca la necesidad de diseñar una gestión más integral y con enfoque holístico de las migraciones y, por ende, de las políticas migratorias en estrecha coordinación con las políticas nacionales o europeas de cooperación al desarrollo.
Llegados a este punto, se destaca el vínculo del Codesarrollo y los Derechos Humanos como elementos de la agenda migratoria entre UE y Latinoamérica. Para ello se matiza principalmente, que las políticas migratorias de los países implicados deben contemplar el codesarrollo como una de las formas para avanzar en la búsqueda de los beneficios mutuos. Se concluye que hasta ahora, las políticas migratorias de los países de destino de los flujos migratorios se han centrado en el reforzamiento de las medidas de control.
Por último, y siendo uno de los más difíciles, se pretende plantear los retos para la UE en sus relaciones migratorias con Latinoamérica. Existe un consenso a nivel internacional y regional sobre la necesidad de potenciar los cauces legales para emigrar como contrapeso a los cauces irregulares que ponen en riesgo la vida de los inmigrantes y evitar que sean sometidos a redes criminales que abusen de ellos, son entre otros puntos los retos actuales para la migración internacional.
Finalmente, se expone unas conclusiones que están enfocadas desde un punto de vista crítico, inclinadas en favorecer la migración internacional por los efectos positivos que representa en los implicados en el proceso migratorio y de reiterar la importancia que merece desde una mirada holística.
La metodología utilizada está apoyada en el método cualitativo, siendo un trabajo que se fundamenta en una realidad global, holística y polifacética. Es exploratorio, descriptivo e inductivo. Tomando tanto fuentes primarias como secundarias en la base de referencias.

The present article is a broad reflection on the elements that should characterize the design of migration policies adapted to the current global world, and especially to the relationship between Latin America and the European Union in the context of migration and development.Among the essential elements, we can find the international cooperation, co-development between countries of origin and destination, two-way migration policies that favour legal migration, full respect for human rights and adequate integration and inclusion in the country of destination.
This study analyses the main challenges between both regions, which must be addressed by the design of migration policies between the country or regions of destination and the country or region of origin. The importance of safeguarding the reduction of the negative effects of irregular migration and enhancing the positive effects of migration processes is highlighted. All States, both of origin and destination, should reflect on what legal framework and policies should be implemented to ensure a coherent and effective migration policy as an achievement that can contribute simultaneously to encourage the development of the countries involved.
In this sense, the main objective is roughly considered: The analysis between migration and development on the Euro-Latin American political agenda. At the epicentre of the agenda, it would be advisable that human rights are taken into account in the process of drawing up migration policies and guarantees that international migration must have from the Human Rights point of view are safeguarded.
The present analysis is based on a general approach to the scope of migration at a global level, international migration as a phenomenon and its dynamics in a global world. The European Union, faced with the obvious advance of migration, is aware of the need to regulate these flows based on the principles of responsibility and solidarity in a more fair and humanitarian way, between Latin America and Europe.
In order to be aware of the scope of the migratory phenomenon between both continents, the scope of the migratory phenomenon in Latin America and the Caribbean is discussed in another section, being one of the regions that is experiencing migration quite intensely.
In the case of Colombia, the lack of opportunities, inequality and internal violence are some of the factors that forced migration. However, a shift in migration flows is clearly shown, according to the report of the International Organization for Migration of 2015, which stresses that North-South migration as a result of the economic crisis in the EU has generated return movements of Latin American nationals and, in parallel, a movement of circular immigration of nationals from EU member states in search of labour opportunities in Latin America.
The third part of the analysis aims to outline the European Union’s Agenda for Development Cooperation with Latin America and the Caribbean (LAC), especially in the case of Colombia. The European Union is committed to incorporating and integrating Human Rights into the cooperation for development, being considered by Colombia as a key partner to contribute to its economic and social development. In order to achieve this main objective, framework agreements are developed between the European Union and Latin America, allowing the implementation of projects that benefit both parties, as long as human rights are respected and guaranteed.
According to the above, emphasis is put on the relevance of Cooperation and Development on Migration, and its special impact on the Colombian case. Some reflection is needed on the importance of the connection between migration and development. To achieve this, the starting point are the different perspectives that must be taken into account when the decision to migrate is made and that must be analysed from different general factors (economic, social, etc.). In this sense, the need to design a more comprehensive and holistic approach to migration is emphasized and, therefore, to migration policies in close coordination with national or European development cooperation policies.
At this point, the link between Co-development and Human Rights is highlighted as elements of the migration agenda between the EU and Latin America. For this purpose, it must be mainly pointed out that migration policies of the countries involved should consider co-development as one of the ways to move forward towards the search for mutual benefits. The conclusion is that migration policies of destination countries on migratory flows have focused so far on the reinforcement of control measures.
Finally, and being one of the most difficult ones, it is intended to raise the challenges for the EU in its migratory relations with Latin America. There is a consensus at international and regional level on the need to strengthen legal channels for migration as a counterweight to irregular channels that endanger the lives of immigrants and prevent them from being forced to criminal networks that abuse them; these are, amongst others, some of the current challenges for international migration.
Finally, we present some conclusions that are focused on a critical point of view, shifted in favour of international migration because of the positive effects it represents in those involved in the migration process and to reiterate the importance it deserves from a holistic perspective.
The methodology used is supported by the qualitative method, being a work that is based on a global, holistic and multifaceted reality. It is exploratory, descriptive and inductive, taking both primary and secondary sources as a reference.
