    RESUMEN. El artículo analiza la Sentencia emitida por el Tribunal de Apelaciones en lo Civil de Cuarto Turno el día 19 de marzo de 2014, particularmente, respecto a la temática de la justa compensación expropiatoria en los casos en los que hay demora estatal en el pago del precio. Se estudia el razonamiento y argumentación aplicada en el fallo, el cual parte de la disposición constitucional que regula esta materia, y de larecepción de la interpretación desde o conforme la Constitución. Asimismo, se analizan algunos aspectos de la noción de reparación integral y su vinculación con la tutela jurisdiccional efectiva. Se profundiza, entonces, en la importancia de dicha Sentencia para el derecho uruguayo, pues ha partido de la Constitución para el análisis del caso concreto, aspecto que la hace ser un precedente de gran valoración en la materia.

    ABSTRACT. The article analyzes the decision of the Fourth Court of Civil Appeals of Uruguay, issued on March 19, 2014, particularly, with regards to the fair compensation in expropriation cases where there is a State delay in the payment of the price. It studies the reasoning and argumentation applied by the Court, which start from the constitutional clause applicable to the case and the reception of the interpretation from the Constitutiondoctrine. It analyzes, also, some aspects of the concept of integral reparation and its connection with the effective judicial protection. It focuses on the importance of this judgment for the Uruguayan system, as it has started the resolution of the case from the Constitution, making it a precedent with a high valuation on this subject.
